An application for a credit card company?
Defaults on credit cards are at their peak. Too many consumers get too many cards and then can not keep up with payments.
If a credit card company files a complaint against him after If defective, they must prove certain issues in order to prevail in its case. First, it must prove they have the right to sue you. This can be done by any number of ways.
The credit card company must produce some kind of documentation that was agreed to establish an account with them. This would normally be through a written request with your signature. Failure to submit that document, you can have a defense or exception the demand. As you are aware, many credit accounts are being opened via the Internet or by telephone. In such cases, the credit card company should be able to produce an electronic signature page of Internet applications, or you should be able to produce written documentation that at least one summary of the oral telephone request. If they fail to produce the documents, again, you may have a valid defense or oppose the application.
The next question that the credit card company to try is the point of view of the account. This would include the principal objections, the interest rate, the rate of default, the payment terms and measures in case of default. These terms are usually sent to you after opening the account, or included with your request in writing. Many times, companies amend credit agreement, while their account is active, and are obligated to send a copy of new terms. This becomes a crucial component in a case of collection of credit. The company must demonstrate that terms apply to the charges on your account. A failure to do so, for its part can provide a defense reasonable or objection for you as a consumer.
The next question that the credit card company must demonstrate that a defect occurred, and have the right to sue. This is demonstrated by the mere presentation of proof of lost pay.
If a company credit card can produce sufficient evidence of the above then you may have a valid defense against any claim that may be brought against him. Please be sure to consult your local attorney regarding the laws of your state, and cases of credit card collection.
