Obama marks the beginning of "fair and transparent" Credit Card Regulation
In a sweeping motion which aims to provide hundreds of thousands of Americans help with credit card debt, President Obama signed the bill last month that the legislation will put an end to card companies establishing credit and rate surges exorbitant fees and penalties on cardholders.
In the days before the Senate was set to vote legislation on proposed credit card, Obama, in his weekly radio address, called on Congress to approve the bill, spoke of an urgent need for new the law of credit cards to consumers economically exploited with some debt relief and credit to help "clear the rubble of this recession."
Obama's radio address followed an earlier report by Fitch Ratings found that a record number of consumers in 60 days or more behind on their payments card credit in April ("Fitch: Credit card delinquencies Arise, show signs of slowdown," CreditCards.com, May 7, 2009).
"The Americans know they have the responsibility to live within their means and pay what they should, "the president said." But we also have the right not to get ripped off by the sudden rise in rates, hidden fees and unfair sanctions that have become too common to our credit card industry. "
New Regulation of credit cards offer debt relief to Cardholders
The House of Representatives, April 30 approved its version of a bill to reform credit card, call Bill cardholders credit "of Rights. Among other things, the bill credit holders of rights requires credit card issuers maintain an introduction "teaser" rates for at least six months and a ban retroactive increases interest rate on the card holder of the existing credit card balances.
The Senate version of the bill, the credit Card Accountability, Responsibility and Disclosure Act, which passed by a vote of 90-5 on May 19, merged with the credit holders card "of the House Bill of Rights and signed into law by President Obama on May 22. In addition to the measures proposed by the House, Senate Credit CARD Act provides consumer protections and other debt relief provisions:
- payments in a consumer must apply to higher balances of interest rates first.
- If a delinquency rate does a cardholder interest rise, the owner may claim the lower rate after six consecutive months of timely payments.
- Cardholders must consent to have the ability to charge more than your credit limit. If an owner chooses not to allow excess spending limit in his or her credit card, the card issuer can not allow the cardholder to charge more than you or your credit limit and then slap holder card with a penalty for exceeding the limit.
Debt Help with credit card interest rate controls
Perhaps most notably, the credit card companies will have to provide consumers with 45 days' notice before raising interest rates significantly or increase the price of the versions – a provision of the House and Senate legislation and a particular topic sensitive for consumers and consumer advocates over the past year as credit card rates have skyrocketed, a result of attempts by banks in trouble recover the losses of a growing number of non-owners.
Estimates from the Center for Responsible Lending, an estimated 10 million users card in the last six months saw their interest rates jump for no apparent reason, with some consumers registered a remarkable increase of 10 percentage points or more.
Under the new law, increases in interest rates are prohibited outright in the first year that a consumer has a credit card.
Congress also responded to a persistent criticism of Obama that the credit card terms and agreements are too abstruse and impenetrable for consumers to easily understand.
"You need not fear that any new credit card will come with conditions, or if you need a magnifying glass and a book query to read a credit card application, "Obama said in his radio address." It is time that the rules are fair and transparent. "
Credit Card Law dictates that the cardholder agreements must be written in "plain English" and posted online, and gives guidelines for the type of language and even the font size that credit card companies can use to explain their business perspective to clients.

Although the Federal Reserve had already approved many of these measures the same credit card in December by attempt to curb abusive credit card practices, the rules of the Federal Reserve is not expected to come into force until July 2010. Spurred by a growing number card holders defaulting on their credit cards and Turning to the options for debt relief the payment of credit card debt and bankruptcy, consumer groups had been demanding that the president continue to push for a reform of the credit law cards that could help fight card holders before.
And with the new legislation, consumer advocates have gotten their wish: The Card Credit Law shall enter into force in February 2010.
"No time to lose," said Obama himself. "We need a durable and successful flow credit in our economy, but we can not tolerate profits that depend mislead working families. Those days are over. "
